MAGNIFIER MAGAZINE KIDS’ ART CONTEST
OFFICIAL RULES AND PARENT/GUARDIAN CONSENT
By submitting an entry on behalf of a child and by clicking the required Parent/Guardian Consent and Release button on the online entry form, and uploading the Consent Form you (the “Parent/Guardian”) agree to these official rules (the “Official Rules” or “Rules”) and consent to your child’s participation in the Contest and to the use of your child’s artwork, image, age, and likeness as described below.
ARTICLE 1: ORGANIZATION AND PURPOSE
Magnificat Inc., with mailing address at PO Box 822, Yonkers, NY 10702 (”Magnificat”), organizes an art contest every two months in connection with the bimonthly publication of Magnifier magazine (the “Magazine”), with a different theme for each issue (the “Contest”).
The Contest invites eligible children to create and submit an original artwork based on the theme announced in each issue of the Magazine. The Contest is a skill-based contest designed to recognize originality and creativity in children’s artwork.
ARTICLE 2: ELIGIBILITY AND CONDITIONS OF PARTICIPATION
2.1 Eligible Participants
Participation is open only to children who, at the time of entry are under16 years old, inclusive. Each eligible child is referred to as a “Participant.”
Employees, officers, or directors of Magnificat or its parent, affiliates, or subsidiaries, and members of such individuals’ immediate family (spouse, parent, child, sibling) are not eligible to participate as Participants.
2.2 Parent/Guardian as Entrant
Because Participants are minors, a Parent or legal guardian must submit the entry on the Participant’s behalf.
By submitting an entry, you represent and warrant that:
- You are at least 18 years of age;
- You are the Participant’s parent or legal guardian; and
- You have the legal authority to agree to these Official Rules, grant the permissions described in these Rules, and provide any required consents and releases on the Participant’s behalf.
Magnificat reserves the right to request written proof of parental or legal guardian status and consent at any time. Failure to provide such proof upon request may result in disqualification.
2.3 Number of Entries
The Contest is limited to one (1) entry per Participant per contest edition (same child, same email address). Each entry may include up to three (3) photographs of the same artwork, as described below.
Participants and Parents/Guardians may not enter using multiple email addresses, identities, or devices, submit more than one entry per contest edition, or use any automated or fraudulent methods to participate.
2.4 Acceptance of Rules
Participation in the Contest constitutes full and unconditional acceptance of these Official Rules by the Parent/Guardian on behalf of the Participant. Any practical difficulties in interpretation or application of these Rules will be resolved by Magnificat in its sole discretion.
Except for requests concerning these Rules, Magnificat will not respond to written or telephone inquiries regarding the mechanics or results of the Contest.
ARTICLE 3: CONTEST PERIOD; HOW THE CONTEST IS ANNOUNCED
3.1 Contest Period
For each issue of the Magazine, the Contest is open for a specific period (the “Contest Period”), which will be indicated in that issue.
If no opening and closing dates are specified in a particular issue, then the Contest Period for that issue will begin on the publication date of that issue and will end 45 calendar days after that publication date. All entries must be received by Magnificat by 11:59 p.m. Eastern Time on the last day of the applicable Contest Period.
3.2 Announcement of the Contest
The Contest may be announced by any or all of the following means:
- The Magazine (print and/or digital versions);
- Magnificat’s communication media (including newsletters and social media); and
- The Contest page on the website: https://www.magnifiermagazine.com/contest/ (the “Contest Site”).
3.3 Right to Modify or Cancel
Magnificat reserves the right, in its sole discretion, to postpone, modify, cancel, extend, or renew the Contest and/or the prizes if circumstances beyond Magnificat’s reasonable control so require. In any such case, Magnificat shall not be liable for any resulting loss or damage.
ARTICLE 4: HOW TO ENTER; CONTEST RULES
4.1 Artwork Requirements
To participate, the Participant must create an original artwork (the “Work”) that reflects the theme announced for the corresponding issue of the Magazine. The Work must be created by the Participant alone (no assistance or collaboration that would be considered substantial, and no AI-generated artwork).
The Work must not contain any inappropriate, violent, hateful, harassing, sexually explicit content, defamatory content, unlawful content, or content that would violate any third party’s rights, including copyrights, trademarks, privacy, or publicity rights.
4.2 Submission of Entries
During the applicable Contest Period, the Parent/Guardian must submit the Participant’s entry online as follows:
- Visit the Contest Site at: https://www.magnifiermagazine.com/contest/
- Click on the button or link indicated to participate (e.g., “Click here to participate”).
- Complete the online entry form by providing all required information, including:
- Participant’s first name;
- Participant’s age;
- Participant’s state or territory of residence;
- Parent/Guardian’s full name and email address; and
- Any other mandatory fields indicated with an “*”.
- Upload up to three (3) photographs of the Work, in the formats and within the file-size limits specified on the Contest Site.
- Read these Official Rules and the Magnificat’s Privacy Policy (linked on the entry form).
- Check the required box labeled, substantially:
- “By entering, I agree to the Official Rules.”
- “I am the parent or legal guardian of the child named in this entry.”
- “I consent to the use of my child’s artwork, image, age, and likeness as described in the Official Rules.”
- Click the “Submit,” “Enter,” or similar validation button to submit the entry.
Entries that are incomplete, inaccurate, illegible, corrupted, or received after the end of the Contest Period will be void and will not be considered. Entries submitted by any means other than through the Contest Site (for example, by mail or email, unless Magnificat expressly instructs otherwise) will not be accepted. Parents/Guardians are responsible at all times for the accuracy of the information provided.
ARTICLE 5: SELECTION OF WINNERS
5.1 Judging Process
After the close of each Contest Period, from among all eligible and valid entries received by the deadline, a jury composed of members of Magnificat’s editorial team and/or invited judges (the “Jury”) will review the Works and select a minimum of five (5) winners. Judging will normally take place within approximately one (1) month after the start of the Contest Period for that issue, but Magnificat may adjust this timeframe as needed.
5.2 Judging Criteria
The Jury will evaluate entries based on the following criteria: originality, creativity; and expression of the announced theme.
Each valid entry will be judged individually on its own merits. The Contest is a skill-based competition; chance plays no role in the selection of winners.
5.3 Jury Decisions Final
The Jury’s decisions regarding the selection of winners are final and binding in all respects. No challenges or appeals regarding the Jury’s decisions will be considered.
ARTICLE 6: PRIZES AND WINNER ANNOUNCEMENTS
6.1 Publication of Entries
Subject to compliance with these Official Rules and Magnificat’s technical and editorial limitations, Magnificat may publish some or all eligible Works on the Contest Site in a section dedicated to the Contest, for a period determined by Magnificat in its discretion.
Such publication may be accompanied by the Participant’s first name, age, and general location (for example, city and state). Publication of a Work does not guarantee that the Participant will be selected as a winner.
6.2 Prizes
For each Contest edition, at least five (5) Participants will be selected as winners (each a “Winner”). The prizes may include some or all of the following, as described on the Contest Site or in the applicable Magazine issue:
- Publication of the Work on the Contest Site, accompanied by a notation such as “Winner,” for a period determined by Magnificat.
- Publication of the Work in a future issue of the Magazine, in print and/or digital format. The issue, placement, size, and any accompanying editorial content will be determined by Magnificat in its sole discretion.
Magnificat may, in its discretion, offer additional non-cash recognitions (for example, a book, or a subscription).
6.3 Prize Conditions
Prizes are non-transferable and may not be substituted or exchanged for cash or other goods or services, except that Magnificat reserves the right to substitute a prize or prize component with one of equal or greater value if the advertised prize becomes unavailable.
No more than the stated number of prizes will be awarded.
6.4 Winner Notification and Publication
Magnificat will attempt to notify each potential Winner’s Parent/Guardian by email using the email address provided at the time of entry, within a reasonable period after winners are selected.
Magnificat may publicly identify Winners as follows:
- On the Contest Site magnifiermagazine.com;
- On Magnificat’s social media accounts; and
- In a future issue of the Magazine.
Identification may include the Participant’s first name, age, and general location (e.g., city and state), accompanied by the Work.
ARTICLE 7: LIMITATION OF LIABILITY; INTERNET
7.1 Internet and Technical Issues
Participants and Parents/Guardians understand and agree that the Internet and communication networks may be subject to interruptions, technical failures, and security vulnerabilities.
Without limiting anything else in these Rules, Magnificat will not be responsible or liable for:
- Any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest;
- Any technical, hardware, software, or network malfunctions of any kind;
- Failures of any telephone or internet service;
- Incomplete, late, lost, misdirected, or undeliverable entries, emails, or communications;
- Any damage to a Participant’s or Parent/Guardian’s computer or other device related to or resulting from participation in or downloading of materials in connection with the Contest; or
- Any other errors of any kind, whether technical, human, or otherwise, in connection with the Contest.
Entries are submitted at the sole risk of the Parent/Guardian and Participant.
7.2 General Limitation of Liability
To the maximum extent permitted by law, Magnificat and its parent, affiliates, subsidiaries, officers, directors, employees, and agents (collectively, the “Released Parties”) are not responsible for and shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Contest or use of any prize.
By participating, the Parent/Guardian, on behalf of themself and the Participant, agrees to release, discharge, and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, or expenses arising out of or related to the Participant’s participation in the Contest or the acceptance, use, or misuse of any prize, except to the extent caused directly by Magnificat’s gross negligence or willful misconduct.
Incomplete or incorrect entries may be rejected without liability to Magnificat. Any false statement or misrepresentation may result in disqualification.
ARTICLE 8: INTELLECTUAL PROPERTY; IMAGE AND PUBLICITY RIGHTS
8.1 Ownership of the Work
Participants (through their Parents/Guardians) will retain all intellectual property rights they may have in the Work, including copyright, subject to the license granted to Magnificat below.
Any individuals whose image or likeness appears in the Work have given appropriate consent (for minors, by their parent/guardian).
8.2 License to Use the Work
By entering the Contest, the Parent/Guardian, on behalf of themself and the Participant, grants to Magnificat and its affiliates a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license (with the right to sublicense) to use the Work solely for the following purposes:
- Operating, administering, and judging the Contest;
- Displaying the Work on the Contest Site and Magnificat’s other websites and social media accounts;
- Publishing the Work in the Magazine (print and digital editions); and
- Promoting the Contest and the Magazine in editorial, promotional, and advertising materials, in any media now known or later developed.
This license includes the rights to reproduce, display, perform, distribute, crop, resize, format, and otherwise adapt the Work as reasonably necessary in connection with the above purposes.
Magnificat will not sell the Work to third parties for publication under their own name for their separate commercial gain.
8.3 Use of Name, Age, Image, and Likeness
By entering the Contest, the Parent/Guardian, on behalf of themself and the Participant, authorizes Magnificat to use:
- The Participant’s first name;
- The Participant’s age;
- The Participant’s general location (e.g., city and state); and
- The Participant’s image and likeness (including photographs submitted with the entry or taken at any Contest-related event),in connection with the purposes described in Article 8.2 above, in any media now known or later developed.
This authorization is granted through the uploaded Consent Form and is granted without additional compensation to the Participant or Parent/Guardian, beyond any prize awarded, and is subject to applicable law.
Magnificat will use reasonable efforts to provide credit to the Participant when the Work is displayed publicly, where practical and customary, but failure to provide such credit in a particular instance shall not constitute a breach of these Rules.
ARTICLE 9: COSTS
Any costs incurred by the Parent/Guardian in connection with participation in the Contest (including costs of creating and photographing the Work) are the sole responsibility of the Parent/Guardian. Magnificat will not reimburse any such costs.
ARTICLE 10: PERSONAL INFORMATION AND CHILD PRIVACY
10.1 Information Collected
By entering the Contest, the Parent/Guardian consents to Magnificat’s collection and use of the following information, which may include:
- Participant’s first name, age, and state or territory of residence;
- Parent/Guardian’s name and contact information (such as email and mailing address);
- Participant’s or Parent/Guardian’s geolocation information;
- Participant’s persistent identifiers (cookie, IP address, device serial number, etc.)
- Photographs of the Work and, if provided, photographs of the Participant; and
- Any other information voluntarily submitted through the entry form.
Providing this information is required for the Participant to take part in the Contest.
10.2 Use of Information
Magnificat will use the collected information for purposes that may include:
- Administering and operating the Contest, including verifying eligibility and judging entries;
- Contacting Parents/Guardians regarding entries or potential prizes;
- Publishing and promoting the Contest and the Magazine, in accordance with these Official Rules; and
- Maintaining records consistent with Magnificat’s business needs and legal obligations.
10.3 Children’s Privacy
Magnificat is committed to protecting children’s privacy. The Contest Site and related online forms are directed to Parents/Guardians, not to children. By submitting an entry, the Parent/Guardian:
- Consents to the collection, use, and disclosure of the Participant’s personal information as described in these Rules and in Magnificat’s Privacy Policy; and
- Acknowledges that Magnificat will treat such information in accordance with applicable U.S. children’s privacy laws (including, as applicable, the Children’s Online Privacy Protection Act (“COPPA”)).
The Parent/Guardian is required for the collection, use, or disclosure of the Participant’s information, and Magnificat will not collect, use, or disclose any personal information from the Participant if the Parent/Guardian does not provide such consent by downloading the attached consent form (the “Consent Form”) and uploading it to the Contest Site in the Participant entry form. The Participant or the Parent/Guardian can, at any time, revoke their consent, which will disqualify the Participant from the Contest.
10.4 Sharing with Service Providers
Magnificat may share personal information with third-party service providers that assist Magnificat in operating the Contest, hosting websites, or performing other services on Magnificat’s behalf. These service providers are permitted to use the information only as necessary to provide the services to Magnificat and are required to handle the information in a manner consistent with applicable law and Magnificat’s instructions.
Magnificat will not sell Participants’ personal information for monetary consideration.
10.5 Retention and Security
Personal information will be retained only for as long as reasonably necessary to administer the Contest, comply with legal obligations, resolve disputes, and enforce Magnificat’s rights, in accordance with Magnificat’s data retention practices.
Magnificat uses reasonable organizational, technical, and administrative measures designed to protect personal information within its organization. All personal information will be deleted once no longer reasonably necessary to administer the Contest.
If a Parent/Guardian wishes to access any personal information Magnificat has collected from the Participant, Parent/Guardian will need to provide the password or PIN provided after submitting the entry form, in order to confirm that the person requesting the information is the Participant’s parent by contacting: [email protected].

ARTICLE 11: AVAILABILITY OF THE RULES
Participation in the Contest implies full and unconditional acceptance of these Official Rules. A current copy of these Official Rules will be available on the Contest Site at:

ARTICLE 12: DISPUTES; GOVERNING LAW
These Official Rules and the Contest are governed by the laws of the State of New York, without regard to conflict of laws principles, except that any mandatory consumer protection laws of a Participant’s place of residence may also apply.
Any dispute, claim, or cause of action arising out of or related to this Contest or these Official Rules that cannot be resolved informally shall be brought exclusively in the state or federal courts located in New York County, New York, and the Parent/Guardian, on behalf of themself and the Participant, consents to the jurisdiction of such courts.
ARTICLE 13: PARENT/GUARDIAN CONSENT AND RELEASE (ONLINE CLICK-THROUGH)
By completing the online entry form and clicking the required Parent/Guardian Consent and Release button, you, the Parent/Guardian, state that:
- You have read, understood, and agree to be bound by these Official Rules.
- You are at least 18 years old and are the parent or legal guardian of the Participant named in the entry form, who is between 7 and 12 years old.
- You consent to your child’s participation in the Contest and to Magnificat’s collection, use, and disclosure of your child’s personal information, artwork, image, age, and likeness as described in these Official Rules and in Magnificat’s Privacy Policy.
- You grant Magnificat the rights to use the Work and your child’s name, age, general location, and image/likeness as set forth in Article 8 of these Official Rules.
- You release and hold harmless Magnificat and the other Released Parties (as defined in Article 7.2) from any and all claims, demands, and causes of action arising out of or in connection with your child’s participation in the Contest or the receipt or use of any prize, except to the extent caused directly by Magnificat’s gross negligence or willful misconduct.
- You understand that you are free to decline to allow your child to participate, and that if you do not agree to these Official Rules and do not click the consent button, your child will not be able to enter the Contest
